SBI & RBI Drama continues – help to aged handicapped persons… sweeping reply from RBI
[Attachment(s) from Chinmay Kar included below]
Differential Treatment to an “Old Aged extreme Disabled Person” by Charging Highest rate of interest @ 14.75% on Pension loan where as interest @ 8-9% being charged for Car purchase & H.B loans by SBI........ SBI was requested to consider conses ion/relaxation to the loan granted to Central Govt old aged extreme pensioner reducing rate of interest @ 9/10%. SBI very boldly declared that they do not have any plan for PWD persons unless RBI permits them. RBI says this is a question to be settled by Bank authority itself. Both SBI & RBI started drama of de-shouldering / avoiding responsibility on each other in respect of PWD persons
Received from Binapanidevi member fb

SUB: SBI &
RBI Drama continues – help to aged handicapped persons…
Remarks
recorded by “Consumer Education and Protection Department, CO, of RBI” {Name
& Designation of signatory not mentioned as such cannot be understood the
capacity & identity of the person replied} may please be seen along with
the entire correspondences made between SBI & RBI higher officials in
connection with help/assistance to old aged extreme disabled persons for ready
appreciation. It appears that the experts of “Consumer Education…..” did not
gone through all the copies of letters exchanged between the parties i.e SBI, RBI & undersigned are always
available/embodied at all letters issued by Chinmay Kar. As regards para 1 of
“Consumer Education – dated 12.08.2015” it is to state that SBI & RBI
remained silent about rendering help/assistance to aged disabled persons rather
avoided by saying they have no scheme for disabled persons where as suddenly
this “Consumer Education…..” came up with sweeping reply of disposal Please
indicate a reference letter from RBI duly indicating name & designation of
issuing authority [as have been done at all earlier letters] in confirmation to
the statement made & claimed now for verification.
As regard
pars 2 it is to state that what has been brought out is simply repetition of
materials brought out vide CGM/SBI’ letter dated 29.8.2013 (Suitably replied to
vide mail dated 15.09.2013) not connected with the issues mentioned to Governor
RBI. As such, sorry, this para & 1 not accepted as a reply/clarification.
In view of
what has been brought out at above it is clear that RBI so long remained silent
even after issue of reminder letter to RBI Governor Mr. Raghu Raman on
06.02.2014 followed by regular reminders just suddenly came out with a sweeping
letter with some clarifications not referred to in any way.
The
subject issue was placed before most aged retired senior citizens having vast
experiences in dealing with administrative business of the government concern,
for their opinion on the entire issue. These elderly persons of the society expressed
doubt that the instant reply / note has not been prepared by an administrative
officer as an administrative officer of a Govt. concern will never write
blindly or not related with subject issue. Letter issued in the name of an
office cannot be taken as an authentic unless name and designation are clearly
indicated. All references mentioned are available at letter itself for
examination, verification etc. Thanking you all.

Madam/Dear Sir,
Please
refer to your trail mail. We advise that the request from the
complainant about the loan at concessional rate of interest was examined
by SBI and the complainant was suitably advised with the reasons behind
their inability to acceding to his/her request.
It
is further advised that Interest rates on advances have been
progressively deregulated by Reserve Bank of India with effect from
October 18, 1994 and banks are therefore free to determine the lending
rates on the advances as per their Board approved policy. RBI never
interferes with that.

Dear Sir,
COMPLAINT
PENSION LOAN: LOWERING OF INTEREST RATE
We
are in receipt of your e-mail dated 22.05.2013, requesting for
reduction of interest rate on your Pension Loan account at our
Tollygunge New Theatre’s Studio Branch (05680), West Bengal.
2. We have examined the same and have to advise as under:
(a) The
rate of interest in an account is linked to the Bank’s Base Rate and is
increased / decreased whenever there is a revision in Base Rate.
(b) The
Reserve Bank of India (RBI) has not mandated any concessional rate on
loans to pensioners / physically handicapped persons. Further, RBI
guidelines on the subject, stipulate, inter-alia that the interest rate
charged by the Bank should incorporate risk premium and in considering
the question of risk, the presence or absence of security and the value
there of should be taken into account. As you are aware, Pension Loans
are clean advances with NIL security.
(c) Reducing
the rate of interest based on the request of a borrower on a standalone
basis is not feasible as it is discriminatory and may result in a spate
of similar requests / complaints from all over the country.
3. We, therefore, regret our inability to accede to your request for lowering of interest rate on your Pension loan.
4. The
Bank will be glad to offer all its Banking services to you in future as
well in accordance with the extant criteria and norms.
Yours faithfully,
Sd/-

Sub: Reducing highest interest element for loan to Retd. Disabled Person
Ref: Interim reply to your letter No. PB / PL / 177B / 118 dated 29.08.2013
(Received by undersigned on 14.09.2013)
Priyo Mahoday,
Thank
you very much for your letter quoted above. It is presumed that the
letter has got the approval of the authority to whom letter dated
22.05.2013 was addressed as instant issue is a policy decision of the
bank related to concession / relaxation / exemption s etc to be provided
to Persons with Disability & Old Aged Persons with Disability in
terms of Government of India’s declarations made by POI & PM / India
from time to time. I have no problem / complain in connection with
Pension loan sanctioned to me except that some quarry was made with
regard to minor departure of system prevailing but no answer received
from dgm.customer@sbi.co.in , latest reminder in this respect issued on 7th Aug’2013. I strongly object inclusion of subject as “COMPLAINT”
at your letter quoted above. Probably you are not aware that SBI’s
comments recorded on “Rastrapati Bhaban Secretariat Portal” as follows” “PRSEC/E/2012/06124
Name:Shri chinmay kar Date of Receipt:26 Apr 2012 Current Status:Case
disposed of Date of Action:15 May 2012Details: The complainant obtained
the pension loan as per the then prevalent norms of the loan. As per
the agreement and arrangement leeter, duly executed by Sri Kar, the
interest is being chaged as per the laid down stipulations of those
documents. Bank has no scheme for disabled Sr. Citizens' Pension Loan. The said complaint is more in the nature of a representation rathen than a complaint for moderate interest between 8 to 9% after reducing it from the agreed rate”
Your expression against para’B’ is contradictory to CGMCSD / RBI’S letter dated 1st
Feb’2013 to the undersigned. Question of ‘risk element etc’ does not
arise for a pension loan as the entire pension element remains under
custody of executive banker and in the event pensioner expired a
declaration deed obtained from pensioner’s wife to the effect that “in
the event of pensioner’s death EMI may be deducted from her F/ Pension”.
Hence it is presumed that with an intention to increase volume of
letter the same has been included. However a consolidated reply to your
letter dated 29.09.2013 will be sent as soon as comments / opinion are
received from entire expert well wishers to Person with Disability and
concerned Government authority. In any case the letter dated 22.05.2013
will stand good. It is noted that you have very intelligently
deshouldered responsibility with regard to Physically Handicapped
persons to Reserve Bank authority and did not offer any remarks on
“Differential Treatment made to Old Aged Disabled Person” pointed out to
you vide letter dated 18.08.2013 & 06.09.2013 which clearly violets
provision made under Declaration
on the Rights of Disabled Persons Proclaimed by General Assembly
resolution 3447 (XXX) of 9 December 1975, signed by India as a member
nation, especially matters pertaining to Differential Treatment to a
PERSON WITH DISABILITY.
Assurances recorded under para 4 of your letter is general in nature and since SBI have BOLDLY declared that they do not have any scheme for Sr.Citizen Persons with Disability (as RBI
did not issued any instruction in this regard) it is not understood how
this assurances will help an extreme disabled poor person like
undersigned. However I will be glad if the “Dear Friends PWD” at
annexure is widely circulated at all SBI offices
However
we may expect that the issue may be settled with in a month so that a
befitting article / report be sent to world forum for PWDs during
ensuing “INTERNATIONAL DAY FOR DISABILITY – 3rd December’ 2013”. for useful wide discussions.
Hope this will find you in a good sprit and excellent healthy mood. However thank you once more. Namaskaram,
Please see Annexure.
