                              Sub: Special attention needed for Aged Disabled Persons-

                                       So far neglected by all in all respect. 

This is a submission to our beloved Prime Minister, Manmohanji that he will kindly spare 10 minutes and read this article as a simple Sr.Citizen of the country to realize the actual status / position of Persons With Disability and how they are treated. Since practically nothing has been done for betterment of aged PWDs you may kindly like to take some remedial actions / actions on some suggestions made available to your government for implementation. Some example of non cooperation, neglect, ignore, non adherences to instructions, guidance given by POI & PM may kindly be seen for further necessary action from your end at the earliest possible.

1.     RAILWAY’S ACTIVITY

As the undersigned is a retired, paralyzed disabled cannot move without an escort made an appeal to railways since 07.06.2009 to allow my attendant / escort on railway pass to accompany me in coach I travel. As per normal practice attendant gets accommodation some 4/5 coaches away from me and thus of no use.  More than 3 years gone, 138 reminders have been issued but railways did not response, probably railway administrators do feel it below dignity to response to a Sr.Citizen, Paralyzed Disabled. Copy of reminders available with PMO may kindly be seen.

2.     STATE BANK OF INDIA’S ASSURANCE FOR PWDS?

I was sanctioned a pension loan of Rs.1.5 lks towards marriage of my younger daughter in June’2010. EMI @ 533/-, Interest element @ 14.75%. Since market price has gone up considerably, become unbearable for this poor disabled pensioner, to tune down the highest interest element a request was made to SBI authority to reduce higher rate of interest of 14.75% to 8 or 9%. Initially SBI turned down the request made and declared boldly that they do not have any scheme for Disabled Persons & on some flimsy grounds which was objected, clarified and resubmitted to Chairman / SBI for consideration and justice. SBI authority assured they ensure justice for Persons with Disability. Case now rest with Chairman / SBI for his consideration. Simple prayer to allow Disablers escort yet to be allowed but railways have arranged free charity distribution of costly railway passes to various persons of the society having no connection with railways or railway works.

3.     ACTIVITY OF COMMISSIONER DISABILITY / WEST BENGAL

Considering financial constraints of this poor pensioner, paralyzed disabled who cannot move out side without an escort but can use computer with unusual left hand towards social welfare works for betterment to aged disabled persons, Governor, West Bengal Sri. Gopal Kr.Gandhi (2009) and Social Justice & Empowerment Ministry recommended to provide me a computer for my use. SJE’s Proposal case bearing No. Case No. 48/1141/09-10 shuttled between Delhi and Kolkata over a period of 3 years now resting with Commissioner Disability / West Bengal / Kolkata. Practically no useful purpose served to a PWD like me even though Governor and SJE Ministry recommended. What has happened to the funds made available to MPs towards requirements of PWDs. Correspondences entered into by Commissioner Disability / Kolkata to utilize MP’s fund but stopped chasing. Thus nothing has been done for PWD.

4.     SOME SUGESSIONS GIVEN FOR RAILWAYS & ROADS

     IMPLEMENTATION FRIENDLY TO PWDS

    

    “MORE SUGGESTIONS - USEFUL TO AGED & DISABLED PERSONS in railways (India)

dated 02-02-2010 was sent to railways for implementation. Only GM / W.Rly informed that they will examine and do needful. Suggestions made are very useful and friendly to PWDS. Till date not fully implemented.

     5.  SJE COULD NOT SAY IF EXEMPTIOS, RELAXATIONS OR ANY PROVISION EXIST FOR OLD AGED DISABLED PERSONS.

Ministry of Social Justice & Empowerment, Govt. of India was requested to let me know whether there exists any rules framed for old aged disabled persons allowing exemptions, relaxations special provisions (other than financial aspects) made for these victims so that they can get their works done early in appreciable manner on humanitarian grounds. Sorry to inform that SJE till date could not reply or able to clarify the correct position. Exact reason for silence is there exist no exemption, relaxation or special provision for old aged disabled persons. Incidentally Secretary UN Org (Disabled) on being referred on the similar line has informed vide e-mail dated 02.04.2009 “Please see our website for more information on the Convention on the Rights
of Persons with Disabilities, which is a legally binding treaty on Governments.. Also, India has ratified the Convention on 1 October 2007"   SJE was requested to let me know whether any directive has been issued by Govt. of India based on Secretary UN Org (Disabled)

It may be seen from above that nothing has been done for betterment for old aged Disabled Persons and as such it is requested to kindly consider issuing suitable instruction to an active secretary to look into the subject issue and take suitable actions so that old aged disabled persons are benefited. It is hoped that some fine morning some kind hearted administrative authority may think twice…….. keeping in view the theme of INTERNATIONAL DAY FOR DISABILITY – 2012Excuse me for inviting your kind attention to the prayers made to Railways Minister during Miss Mamata Banerjee’s  period for consideration of allowing my escort to accompany me in coach I am traveling owing to my absolute disability. Prayer has been made purely on humanitarian, religious / pilgrimage reasons by a Retd. Sr.Citien, Extreme Disabled / Disability persons at the fag end of their life for due consideration as a token of cognition of services rendered appreciated by Railways through 17 awards. I am well aware that existing rules does not cater such provision but rules are made by human being & not by Lord God or treated as Bible, necessity, justification demands change, amend consideration on humanitarian reasons. Hope Government ofIndia acting through the Railway Ministry will not debar this aged couple in performing their religious intentions already narrated before your predecessors. In this respect it will not be out of place to mention that expenditure likely to be incurred in allowing prayed issue will be absolutely negligible from finance point of view and as such there should be no reason to hold on. Incidentally with an intention to visit Ma Tara Temple at Tara pith, Kamrup Kamakhya at Gauhati, Tirupati Devasthanam, Hardwar etc to offer Puja for betterment of all of us submitted pass application to GM / M.Rly / Kolkata during past three years.  Sorry till date since no directive issued from RailBoard’s office, escort could not be included in pass by concerned GM. All religious programmed made had to be cancelled on account of railways. Thus continuously debarred to perform religious obligations at the fag end of life which is virtually my constitutional right. Kind attention is also invited toDeclaration on the Rights of Disabled Persons Proclaimed by General Assembly resolution 3447 (XXX) of 9 December 1975especially matters pertaining to Differential Treatment to a PERSON WITH DISABILITY. Hope you will be kind enough to study the entire situation & issue suitable instructions as prayed for to the concerned GM / M.Rly /Kolkata., copy to undersigned as immediately as possible and oblige. Kindly don’t hesitate to tell your constraints if any. Escort will be chosen by PWD himself. Incidentally it is mentioned that the delay resulted deterioration of my disability which may kindly be noted,

                                A very simple prayer made above on necessity & Humanity ground by a Retd. Disabled, Sr.Citizen of India, Humanitarian prayers made through 136 letters / reminders may please be seen.  Every appeal cum reminders is self explanatory. Railway did not acknowledge receipt nor a response made so far. Railways cannot deny receipt of136 letters / reminders mail from me

                               Since the undersigned, a paralyzed Disabled (entire right side of the body paralyzed) can’t move without an escort certified by a CMS of Railway Hospital submitted an appeal to highest authority of railways to allow his attendant / escort to travel in the same coach with me on the pass granted to me as per prevailing rules. Normally an attendant / escort has to travel at general sleeper coach 5 / 6 coaches away from the coach traveled by the pass holder and as such does not helpful to a Disabled like the undersigned.

                                 Situation being as mentioned above do our respected Chairman Sahab can deny that:-

1)    By way of remaining silent for 2188+ days, even after issue of 136 letters/reminders tantamount to a Neglect / Ignore / insult made to a Senior Citizen, Paralyzed Disabled, can’t move without an escort, made by railway authority?

2)    By way of remaining silent over three years from the date of receipt of 1^st appeal made on 07-06-2009 allowed this physically disabled person (68 yrs) deteriorating physical handicapped ness to further extent. Railways silence caused my deterioration condition of Disability further which could have been avoided provided Railways at the initial stage of my appeal communicated the Disability of Railways to help / accept the simple prayer of a Senior Citizen, Paralyzed Disabled, who can’t move without an escort. Hence Railway is totally responsible for the damage done to a Disabled

Railways could not consider a very simple prayer of a genuine very aged extreme Disabled Person though all papers / documents relating to eligibility to get an escort to travel with the Disabled in question but arranged charity distribution of very costly free pass to a large number of  different persons of the society having absolutely No connection with Railway or Railway works at all and thus made a Differential Treatment with a Sr.Citizen, Paralyzed Disabled Person. 3)    Railways silence to the appeals of an Aged, Paralyzed Disabled debarred him in observing / availing religious as well as pilgrimage tours to Thirupati, Kamrup, Tarapith Vaishna Devi etc. This is to be noted that a Paralyzed disabled, can’t move outside with out an escort & if escort cannot accompany the Disabled Person the deserved journey cannot be made by Disabled in question. By such action Railways are responsible for preventing me to avail the fundamental rights of performing religious customary as provided in constitution.

4)    Had Railways at the very initial stage of the appeal made three years back expressed their DISABILITY to help an extreme Paralyzed Disabled Person then the question of Differential Treatment, Ignore, Neglect, Insult, Payment of compensation to a PWD would have not arisen. I would have make some adjustment & proceeded for pilgrimage. Amount claimed towards compensation is Rupees seven lakhs and fifty thousand only.

Hope that Mittal Sahab, well conversant with my case will render proper justice to this Disabled at the fag end of life and oblige, Thanking you, Yours faithfully,

Some few days back I referred a case for your kind intervention of a threat case to a disabled (80%) cannot move out side freely i. e. Sri.Ashim Ghosh, Paschimpara, Bongaon. Very promptly I / C Bongaon and Addl.S.P / N-24Parganas took up the issue and did needful so that victim disabled gets relief. I am thankful to both I / C and Addl.S.P / N-24 Prgs that they have kindly contacted me over phone to have details from this aged disable who can’t move out side freely. Thank you every body for nice job done for Disabled Persons who cannot move out side for whatsoever purpose. As E-Mail ID is not available may I request you to kindly communicate this letter of thanks to concerned I / C and Addl. S.P. and oblige.

Original Post Himadri Sekhar De 7:30pm Feb 3 বদল চাই...বদল হচ্ছে......!!! পুলিশ মানবিক হচ্ছে......!!!! --------------------------------------------------------------- মানবিক পুলিশ, মানসিক ভারসাম্যহীন ছেলে ফিরল মায়ের কোলে (Sorce:ABP) =============================================== মানসিক ভারসাম্যহীন ছেলেকে মায়ের কোলে ফিরল পুলিশের সহায়তায়। ঘটনাটি উত্তর ২৪ পরগনার গাইঘাটা থানার মণ্ডলপাড়ার ৪৮ নম্বর রেলগেট এলাকার। বুধবার গভীর রাতে এলাকায় উদভ্রান্তের মতো ঘোরাঘুরি করছিলেন বছর বাইশের এক যুবক। জামা-প্যান্ট ও জ্যাকেট পরা যুবকটিকে শীতে কাঁপতে দেখে স্থানীয় লোকজন তাঁর কাছে নাম-ঠিকানা জানতে চান। কিন্তু যুবকটি অসংলগ্ন কথাবার্তা বলে থাকে। এতে সন্দেহ হয় বাসিন্দাদের। ডাকাতি করার উদ্দেশ্যে যুবকটি ঘোরাঘুরি করছে এই ধারণা থেকে সঙ্গে সঙ্গে তাঁরা গাইঘাটা থানায় খবর দেন। পুলিশ গিয়ে যুবকটিকে থানায় নিয়ে আসে। দেখা যায় সে মানসিক ভারসাম্যহীন। পুলিশ সূত্রে জানা গিয়েছে, স্বপনের বাড়ি বিরাটতে। মা চিত্রলেখা দেবীর সঙ্গে সে যাদবপুরে আত্মীয়ের বাড়ি বেড়াতে গিয়েছিল। সেখান থেকে মঙ্গলবার তাঁরা বাড়ি ফিরছিলেন। শিয়ালদহ স্টেশনে ট্রেনে উঠতে গিয়ে চিত্রলেখাদেবী পড়ে যান। ট্রেন ছেড়ে দিচ্ছে দেখে তাতে উঠে পড়ে স্বপন। বিরাটি স্টেশনের বদলে সে ঠাকুরনগর স্টেশনে নামে। তারপর ঘুরতে ঘুরতে গাইঘাটার মণ্ডলপাড়ায় চলে আসে। রাত ১২টা নাগাদ স্থানীয় বাসিন্দাদের কাছে খবর পেয়ে এস আই অয়ন চক্রবর্তী গিয়ে স্বপনকে উদ্ধার করে থানায় নিয়ে যান। ওসি অরিন্দম ভট্টাচার্য বলেন, “কথাবার্তায় বোঝা যাচ্ছিল যুবকটি ডাকাত নয়, মানসিক ভারসাম্যহীন। কোনওরকমে ওর কাছে জানা যায় বাড়ি বিরাটিতে। বাবার নাম সন্তোষ পাল। থানায় ওর জন্য খাবার, কম্বলের ব্যবস্থা করা হয়।” ছেলেকে না পেয়ে শিয়ালদহ জিআরপি-তে বুধবার নিখোঁজ ডায়েরি করেন চিত্রলেখাদেবী। তার আগে তিনি বিরাটি থানাতেও খোঁজ নেন। স্বপনের পরিচয় জানার পরে গাইঘাটা থানার পুলিশ বিরাটি থানার সঙ্গে যোগাযোগ করে। বিরাটি থানা থেকে স্বপনের বাড়িতে খবর দেওয়া হয়। খবর পেয়ে ছেলেকে নিতে আসেন চিত্রলেখাদেবী। ছেলেকে ফিরে পেয়ে কাঁদতে কাঁদতে তিনি বলেন, “ওকে ফিরে পেয়ে ভাল লাগছে। খুবই দুশ্চিন্তায় ছিলাম। পুলিশকে কি বলে ধন্যবাদ দেব বুঝতে পারছি না। ওঁদের জন্যই ছেলেকে ফিরে পেলাম।” মা, ঠাকুমার সঙ্গে স্বপন।--নিজস্ব চিত্র।
