Kindly refer to earlier references made to you as detailed below. The Sub divisional Police authority contacted me (17.01.2012) and informed that they have carried out inspection & are taking necessary action to solve the issue. Prompt initiative taken by Police authority towards a Person with Disability is appreciated.

Govt. of India at the appropriate level is once again requested to kindly consider implementation of the proposal sent vide mail dated 31.05.2011 (At Attachment} so that Persons with Disability and those cannot move out side for whatsoever purpose can lead balance life hazardless. In this context I may kindly permitted to add and explain the extreme constraints had to face as a Post Polio Disabled (80%) to lead family life. As a disabled person I had to work at a local electronic shop as a mechanic for electric & electronics at a very low payment. I had to depend on my aged mother for almost every reason due to my disability. Considering age factor of mother & my disability, I got married in Nov’2010. My wife belongs to a poor family & as such no ceremony could be made from either side. Unfortunately after marriage my mother in law start saying to stay with her as she cannot stay with out her daughter. My wife is also interested to stay with her mother and as such she started misbehaving with my aged mother since I had refused to be separated with my aged mother and stay with her mother. Main intention of my mother in law is to avail my small earning and discontinue liability maintenance of my mother. As I have refused to stay with my mother in law repeatedly, she started shouting, threading me with some imaginary allegations at my working place. Recently I am blessed with a daughter but mother in law almost forcibly taken away my wife & daughter to her place of residence and again started threading me along with some of her followers that in case I do not stay with them they will not spare me and I will have to face serious consequences. The situation is so much grave now a day that I am, being a disabled can’t move freely out side, afraid of being man handled at any moment & also afraid to report to police authority. To tell you the truth my life has become miserable only because I am a disabled (80%) can’t move freely had to depend on some body & cannot resist unusual demands made to me.

Under the circumstances brought out at above, may I request the authority to consider inclusion of PWDs who can’t move out side for whatsoever purpose against item No.3 of the “Provisions to be made for old aged disabled persons......” a proposal moved to you by Chinmay Kar under e-mail dated 31.07.2011 (At Attachment) so that a victim like us can be benefited / saved.

Incidentally I would like to request every one of you to kindly forward my case to an appropriate authority so that I can get relief of present trouble and oblige. Your kind help is earnestly solicited.

Proposal moved for kind attention of Govit. Of India and UN ENABLE

The following are submitted for your kind perusal and necessary action for its implementation as early as possible in the interest of old aged disabled persons cannot move out side with out an escort. So far no Relaxations, Exemptions or any special provisions made or exist for old aged disabled persons cannot move out side. Hope you will please needful Namaskar… Chinmay kar 31-07-2011

Exemptions, Relaxations & some special provisions required for Old Aged Disabled persons to ease their lives (With out any type of Financial involvement) for remaining days

(1). Normally old aged disabled persons & those cannot move out side for any purpose had to lead balance life with out accompanied by his sons / daughters for some reasons or other. Naturally these persons had to arrange, clear up / disputes if any related to payment of Electric Bills, Telephone Bills, Income Tax, Bank affairs, Corporation Building Tax, Booking & related works for domestic L.P. Gas etc. It becomes extremely difficult for a disabled person who cannot move out side to attend each & every time to get their requirements. Now a day, it is seen that in each and every matters there exist some disputes which can be settled by personal attendance only. To avoid difficulties by Aged PWDs including those cannot move out side it is proposed to introduce a devise so that OADs can get some relief to carry on an in cumbrance free life.

Relaxation, Exemptios & Spl. provisions rules urged for in respect of constraints:-

“All offices situated in the state of West Bengal deals with issues mentioned at above (Yellow hatched portion) should open a special counter “Help counter for Sr.Citizen, Disabled who cannot move” to entertain requisitions, complains, requests made by the consumer Sr.Citizen, Disabled cannot move out side either through letters or by e-mails and issue receipts, confirm through e-mails. Compliance be made on requisitions immediately and others settled with in 30 days from date of receipt and a compliance Report should be reported to nominated officer of the Govt. nodal officer for the purpose having magisterial powers to take necessary actions against defaulters.”

(2). Old Aged Disabled persons those cannot move out side had to call mechanics for various repair, replacement jobs for, T.V, CPU, Water pipe connection etc. As the OAD persons are normally very week individuals neither can run after the mechanic nor can argue for rates elements strongly for obvious reasons had to depend fully on mechanic (most of them are unknown). In most of the cases it is seen that mechanic takes away the defective elements for carrying out necessary repair works at his work shop but while returning the same replaces the defective elements with a substandard one / unusable elements. Thus OADs are cheated in almost every area. Very recently one computer mechanic taken away my CPU for some repair works but returned me with duly replacing my hard disk with another hard disk of other brand, completely a dead one. The matter was widely brought to the notice of all concerned through different global web site for general awareness. However to tune down reoccurrence of such incidents it is proposed to introduce a positive action lines in terms of lawful provision:-

“Fraud / cheating case made to Old Aged Disabled persons who cannot move out side should be reported to Supdt. of Police of the concerned district by letters or e-mails. On receipt of complains from OAD the concerned S.P will conduct suitable enquiry and take necessary actions as per prevailing rules and report compliance with in 30 days to the nominated officer of the Govt. nodal officer for the purpose having magisterial powers to take necessary actions against defaulters.”

(3). Old aged disabled persons those cannot move out side with out an escort had to depend on available relatives in all respects even for very small necessities. As a result there of some relatives creates undue pressure / threats on the aged disabled person to agree signing of deeds / documents with regard to land, property and assets belonging to OAD in such a way which is accordance with the desire of OAD. Only just because OAD is a physically week person had to depend on them for every purpose & no legal protection is available had no other way but to digest unwanted out come. To tune down such tendency the following is suggested for inclusion at Govt. orders.-

“Whenever an Old Aged Disabled person is required to execute a deed or document in respect of Land, Property and Assets belonging to him the same can be can be acted upon only after certification by a 1^st Class Magistrate to the effect that the deed has been signed by concerned OAD with full consent and not under threat or pressure by any one. Unless such a certificate is issued by 1^st Class Magistrate no executed deed of an OAD person will be treated as valid for enactment.”

(4). Old Aged Disabled Persons who cannot move out side with out an escort are required to attend office (even such directives are issued by the lowest person of an office) to get their documents, receipts, submission of applications, consent letters etc. It is very much difficult for an OAD can’t move out side to attend an office normally situated at thickly populated CBD area but these can be done by authorization, by e-governance or by deputing special messenger to OAD comfortably. A suitable Exemption orders in this respect on the following lines may be issued for the convenience of Old Aged Disabled Persons who cannot move out side for any purpose.

“It is hereby notified that that Old Aged Disabled Persons who cannot move out side with out an escort are Exempted to attend all offices situated in the state of West Bengal for getting their works done. Their cases be settled either utilizing e-governance system or by deputing special messenger to OAD. Deviations if any should be brought to the notice to the nominated officer of the Govt. nodal officer for the purpose having magisterial powers to take necessary actions against defaulters.”

Introduction of above said suggestions will not involve any financial implications on the Government authority. OADs should invariably mention at their applications “CASE OF SR. CITIZEN DISABLED CANNOT MOVE OUT SIDE” to get the proposed facility provided by Government. Government Doctors certificate to the effect that “the disabled person cannot move with out an escort” is obtained from a Government Doctor and produced whenever it is called for by any competent authority.

So far there exist no Relaxations, Exemptions or any special provisions made for Old Aged Disabled Persons cannot move out side wit out an escort for any purpose and as such the suggestions made above will render some relief to OAD persons. Hope Government at appropriate level will not hesitate to implement the above suggestions for betterment to aged disabled persons so long neglected, ignored by all. Thank you.

You might be very unhappy to see such Himalayan Peak of reminders - where it was lying?

Kind attention is invited to the submissions made purely on humanitarian consideration before you under references mentioned at above. Prayer was made when I was aged 64+ & now I am aged 66+. I am afraid that besides physical constraints owing to hemiparasis disability, further deterioration will come up in respect of mental & physical condition within next 2/ 3 years which will not allow me to move anywhere on pilgrimage purpose and there by the very ultimate intention of pilgrimage at the fag end of life will be defeated.

In this context it is apprehended that due to some administrative constraints under extant rules, unless otherwise the issue is treated as special nature of issue of an extreme disabled, purely on humanitarian grounds it could not be acceded to. In case you consider that my prayer is not sufficient enough for consideration, kindly advise me so that the Government of India & others may be prayed for consideration to recommend you. Financial impact to consider such cases on purely humanitarian grounds even up to 1000 cases will incur barest legible expenditure & do not have any repercussion on principle budget made. I however personally do not feel it is necessary as railway ministry (GoI) is sufficiently good enough to take independent decision. For further consideration certain essential documents sent earlier are enclosed at attachment for your ready appreciation.. Incidentally since the e-mail ID of GM / M.Rly / Kolkata does not work properly, sending copy to GM has to be stopped. Hope you will issue necessary directives so that this disabled, Sr.Citizen couple may travel along with escort / attendant provided to them in same compartment. Disabled like me requires at least 2 escorts as I cannot do anything independently i.e. 1) absolute personal & private day to day affairs to be done by my wife only & 2) a physically sound person who can control me in every movement in a running condition as an escort, for which prayer is made.

[i.e. PM, Cabinet Secretary, Sri. Lal Sanglur, Director, Aged Department, Social Justice & Empowerment, Government of India. etc.]

Kindly peruse a request made to the union government of India to consider payment of an ex-gratia payment to the central government pensioners on the eve of principal religious festivals like Id, Durga Puja, X’Mass, Pongal etc considering the acute financial hardship and to join religious customary purpose. Request letters dated 16.10.2010 and 22.06.2011 placed below for ready reference which may kindly be seen for ready appreciation.

Department of Pension & Pensioners’ Welfare vide departmental Portal notification dated 18.10.2011 have deadly turned down the request made by me followed by others quoting a departmental O.M. issued in 1998 / 08. Kindly see the refusal of the Department of PPW reproduced at the bottom of this letter for kind perusal.

Incidentally it is once again mentioned that identical ex-gratia to pensioners are allowed in some states duly obtaining approval of the state cabinet of the ministry. Unfortunately it appears that in the instant case no such move was made instead relied on earlier dated O.M to turn down. We would at least happy to find that the proposal is refused / accepted by an appropriate highest level of the government instrument like central cabinet.

Under the circumstance it is once placed before the highest authority of the central cabinet to reconsider the issue and issue suitable directive considering each and every factual positions brought out. Namaskaram,

Your kind attention is invited to the request made vide mail dated 16-10-2010 (Copy placed below for ready reference) on the captioned subject for consideration at appropriate level. Hope you have gone through the merit of the prayer made and processed for further necessary actions. Since prime religious festival season of the country is approaching very fast & the aged, particularly disabled pensioners started counting down their “days of financial worry ness during incoming religious festivals” the prayer is being brought back on the table. Hope the Government will realize the painful situation and take suitable action to provide some relief. Incidentally it is to mention that the system in question has been introduced at some state government of the country. This is not a grievance, simply a prayer for consideration by Government Thanking you in anticipation. Submitted please.

EX GRATIA PAYMENTS TO GOVT. PENSIONERS ON THE EVE OF PRIME RELIGIOUS FESTIVALS FOR ALL COMMUNITIES-

Market price of all essential commodities has gone through the roofs and as a result there of it has become very difficult to handle additional financial burden in maintaining obligatory requirements connected with religious activity during principal occasions like Id, Durga Puja, Pongal, Christmas Days etc. In most of the cases old aged pensioners are not able to get any assistance from others in these hard days. Extreme critical financial constraints to these aged pensioners during the religious occasions may be appreciated by all.

Considering the financial distress of the aged pensioners during religious festivals some of the state government do allow payment of an ex gratia to their pensioners along payment of bonus to their employees. This system adopted by some state government proved to be very much helpful to aged pensioners. Unfortunately the system is not made available for central government pensioners.

Considering the price hike of the day even salary of the MPs (i.e. Desh Sevaks) had to be increased considerably and as such old aged pensioners may urge government to consider payment of at least 1,500/ as an ex gratia to pensioners while declaring bonus to their employees so that these poor ex- government servants get some relief at the fag end of their life. Union Government of India is requested to consider the issue with sympathy.

“Payment of ex-gratia lump sum compensation is granted on death in perfomance of duty due to accidents, act of violence, enemy action, international war, border skimishes and action against militants, terrorists and extremists in terms of this Department OM dated 11-9-1998 read with OM dated 2-9-2008. Hence, the demand for payment of ex-gratia to Govt. Pensioners on the eve of religious festivals for all communities, is not covered under the provisions of this Department OM dated 11-9-1998 and 2-9-2008.”
